The purpose of these general terms and conditions (hereinafter referred to as “the General Terms and Conditions”) is to define the conditions under which Magic Surf House sells accommodation services to the Customer.
These General Conditions together with the special conditions relating to the sale of accommodation services (hereinafter referred to as “the special conditions”) constitute the contract for accommodation services (hereinafter referred to as the Contract).
Access to accommodation. All adults or minors accompanied by an adult may book at Magic Surf House. The Management reserves the right to refuse a reservation.
Booking conditions. All bookings are confirmed upon payment of the deposit. An unconfirmed booking is not guaranteed, and may be cancelled by the establishment.
Rates are quoted inclusive of tax in accordance with the price list.
Unless otherwise stated, tourist tax is extra. Rates are valid from the first of January to the last day of the calendar year. However, in the event of high inflation, a revision during the year is possible but may not exceed inflation.
Changes in VAT rates or the introduction of new taxes may also lead Magic Surf House to modify the price of holidays without prior notice.
For a stay of less than €500, payment must be made for at least 50% at the time of booking and the balance at the latest at the end of the stay.
For a stay of more than €500, a minimum of 30% must be paid at the time of booking and the balance at the latest at the end of the stay. On request, a receipt will be issued for each deposit and sent to the customer.
Payment must be made either by cheque made payable to Magic Surf House or by bank transfer to the Magic Surf House bank account.
After receipt of the invoice, any delay in payment of more than 30 days will incur late payment penalties (rate of 15% per annum), unless a payment schedule is agreed in advance.
Conditions for modification or cancellation by the buyer
Cancellations must be made by registered letter or e-mail.
Cancellation less than 30 days before the start of the holiday: the maximum cancellation fee is 50% of the price of the holiday, and the deposit will not be reimbursed. Cancellation less than 5 days before the start of the holiday: the maximum cancellation fee is 100% of the price of the holiday, and the deposit will not be refunded.
The above conditions also apply to partial cancellations (a shortened stay is considered a partial cancellation).
Reservations may be postponed for medical reasons or the funeral of a relative up to the second degree, but will not be reimbursed.
If all or part of the booking is refunded, a fixed administration and processing fee of €15 will be deducted.
Conditions of modification or cancellation by the vendor:
Magic Surf House may have to modify or cancel a holiday or service in the event of external events beyond its control. When, prior to departure, compliance with a major element of the Contract is rendered impossible as a result of an external event, we will notify you, informing you that you will then have the option of cancelling the Contract or accepting the modifications that we will propose to you. You must then inform us of your choice within 48 hours. If you decide to cancel the contract, you will be entitled, without penalties or costs, to a refund of all the sums you have paid.
Liability: we advise you to be insured for liability (personal injury or property damage) and theft cover. Our insurance policy covers our sole liability as a company in accordance with law 92.645 of 13 July 1992. It covers risks relating to accommodation and catering.
However, Magic Surf House will be exonerated from all or part of its liability in cases where the non-execution or poor execution of the contract is attributable either to the purchaser or to the unforeseeable and insurmountable act of a third party unrelated to the provision of the services provided for in the contract or in cases of force majeure. In the event that one of the participants causes personal injury or material damage, his/her civil liability may be sought with a view to compensation.
Magic Surf School has drawn up a set of internal rules which are displayed in the establishment. They set out the rules for the use of equipment and life in the establishment and specify the conditions for evacuation.
Residents must comply with French laws and regulations. In the event of non-compliance, the person in charge of the accommodation will call in the gendarmerie.
Accommodation and use of communal areas: Flats must be kept clean and left clean. When you leave, you must undo your bed and put the dirty sheets on the floor. Your rubbish must be sorted in the rubbish bins located nearby. Please ask for the keys to the rubbish bin at reception. The communal terrace must be left clean each time it is used. It should be used sparingly to allow as many people as possible to use it.
Alcohol consumption: Alcohol is not permitted in the flats or on the terrace.
Noise: from 10 p.m. until 7 a.m., special care is taken to ensure a peaceful night’s sleep, so please respect everyone’s peace and quiet.
Safety: if the fire alarm is triggered, residents must assemble in the car park area of the surf house.
Behaviour: all residents must show respect for other residents. If they fail to do so, they may be excluded by the person in charge, without compensation, and legal action may be taken.
Loss – Theft – Damage: we cannot be held responsible for any loss, theft or damage to personal belongings either inside or outside the facilities. We advise against bringing valuables or large sums of money.
Damage: the person responsible for a group, defined as the person who has booked on behalf of several individual customers, undertakes to cover any accidental or deliberate damage caused by one of the members of the group. Each resident of legal age who is a member of a group may also be held liable. Parking in the car park: the car park is reserved exclusively for guests of the hostel and no vehicles may be temporarily parked there outside the periods when they are present in the hostel.
Data Protection Act: in accordance with article 27 of the Data Protection Act of 6 January 1978, you are hereby informed that all information concerning you is collected by Magic Surf House in order to process your booking. It may be used by our services. In accordance with article 34 of the law of 6 January 1978, you have the right to access, rectify or object to the processing of information concerning you.

Photos and images: during a holiday, participants may be photographed in order to put photos online or to illustrate the surf house. As far as possible, faces will not be recognisable. Clients agree that these photos may be used on our website or to illustrate our brochures or those of our partners, as well as press articles and social networks.
They also accept that TV, radio or written press reports may take place during their stay.
The photographs in our documents are not contractual and do not necessarily reflect the exact location on the date of arrival.
Accommodation: participants are allocated to rooms according to availability. Bed linen is provided for all stays.
